What is a GPZU and what is its role in the process of carrying out work related to capital construction or reconstruction of construction projects, many people know. Especially familiar with this issue are those who build housing, including for themselves.
General information
Urban planning plan of a land plot, a sample of which is drawn up in accordance with the requirements established by law, is a set of documents that are related to the planning of a specific territory. The development of documentation is carried out on allotments that have a special purpose. In particular, they belong to the category of allotments intended for the construction or reconstruction of existing capital construction facilities. According to its functional purpose, the town-planning plan of the land plot belongs to the type of information documents. Such documentation contains the building characteristics and existing restrictions regarding the plot intended for development.
Legislative Framework
Forstreamlining work with documents and their distribution in accordance with the information functions performed by the Code of the Russian Federation, adopted in 2004 by Federal Law No. 190, a definition was introduced. According to the Code, the town-planning plan of a land plot is a document in the form of an extract. It contains information about a specific allotment. The sources for creating an extract are the Rules for the development and use of land, projects for planning and surveying the territory. This document indicates information that characterizes a particular allotment, indicates existing building restrictions and allows you to identify it in reality based on physical indicators. The urban development plan of a land plot is a document that does not grant ownership rights and does not define any rights and obligations. It only accumulates information and ensures its multiple use over a long period of time by different users.
Purpose
The objectives of this act are quite diverse. In particular, it is the basis for the development of design documents for existing capital construction facilities, as well as structures that need reconstruction. The urban planning plan of the site is listed in the list of papers required to obtain permits for the construction of the building and its commissioning (with the exception of housing construction projects that were not put into operation before 2014-31-12).

Urban planning plan, a sample of which was approved by the Ministry of Regional Development of the Russian Federation, is drawn up on a special form. A corresponding instruction has been developed for the document, which explains how to fill in all its lines. The structure contains items that contain information:
- About all existing boundaries of this piece of land.
- About existing public easement areas.
- About the size of the minimum indentation of the existing boundaries throughout the land. Such parameters are indicated in order to determine the territory available for the construction of facilities (residential buildings, structures, utility rooms).
- About city regulations (this item is indicated when the site is included in the list of territories covered by city regulations). Here is a list of all types of possible targeted use of this territory. Categories are specified in the city planning regulations. The exception is plots that are provided to meet the needs of a state or municipal nature.
- About the purpose of the land, the requirements for the parameters, the placement and purpose of construction objects on this site. In this case, the allotment should not be included in the scope of the regulation.
- About the objects of cultural heritage and capital construction located within this plot of land.
- About technical conditions, that is, information about existing (planned) connections of objects to engineering and technical support (telecommunications,power supply, gas supply). At the same time, the distance at which the site is located from engineering networks is noted.
- On the boundaries of zones for the capital construction of objects of municipal or state needs.
- On the availability of the possibility of distributing this land plot into several smaller ones or the absence of it.
Regulations
An integral part of the GPZU is the town planning regulation. It is a publicly approved standard that establishes the purpose of the allotment and the main parameters of the real estate objects that will be located on it. The territory regulations are necessary for conducting a state examination, obtaining a permit for construction work and obtaining an act of commissioning a property.
Development of GPZU
You can get a document in two ways. It can be a separate paper or an element of a survey project. Its issuance is carried out by the authorized body on the basis of an application from the owner of the land plot, temporary user or interested person. When issuing, the authorized body must take from the applicant only a document that will allow him to be identified. Disclosure of information about the purpose of requesting the plan or indicating it in any documents is not provided for by law.
Issuance of documentation by municipal authorities
A natural or legal person can apply withan appropriate application for obtaining a town-planning plan for a land plot to municipal self-government bodies. In this case, the procedure for holding public hearings is not required. On the basis of the submitted application, the local authority begins to prepare the document, approves it and issues it to the applicant within a period not exceeding thirty days. At the same time, you can get a town-planning plan for a land plot for free, since the fee for the procedure is not established by law.
Issuance of document by other authorities
In order for the owner of a particular allotment to be able to obtain a GPZU, he must apply with the list of documents established by law to the competent Committee. What is included in the list of papers? The list includes documentation that belongs to the category of title documents. Be sure to provide an extract from the cadastre for the allotment. If there are capital construction facilities on the territory, it is necessary to attach documents that confirm the right to property, and their passports issued by the cadastral department. The town-planning plan of the land plot must be coordinated with the legislative regulations. It is in the coordination, as a rule, that the whole difficulty of obtaining a document lies. This project must be considered and approved by the competent commission or its working group.
Why might a permit be denied?
The Urban Planning Code of the Russian Federation of 2004 (FZ No. 190) provides for situations in which an applicant may be denied permission toconstruction and commissioning of the facility. This is, in particular, the inconsistency of the designed project documentation. In this case, the project may not pass the state examination. At the same time, the relevant commission has the right to write a negative opinion and refuse to issue a building permit. In addition, the created capital construction object or the reconstruction carried out may not correspond to the town-planning plan for the land plot. Having established a discrepancy, the commission prohibits putting the object into operation and refuses to issue a permit.
